Terms of Service

1. Acceptance of Terms

By accessing or using EventsNearMe ("the Platform", "we", "us", or "our") at eventsnearme.io, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Platform.

2. Description of Service

EventsNearMe is a vendor market management platform that connects event organizers ("Organizations") with vendors ("Vendors"). Organizations can create events, post vendor opportunities, manage applications, assign booth spaces, and collect payments. Vendors can discover events, submit applications, and manage their bookings — all in one place.

3. User Accounts

You must create an account to use most features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep your information up to date.

We offer two account types:

  • Vendor accounts — for individuals or businesses looking to sell or perform at events.
  • Organization accounts — for event organizers managing markets, festivals, or pop-up events.

4. Payments and Fees

EventsNearMe charges a platform processing fee on booth payments collected through the Platform. The fee rate depends on your subscription plan:

  • Free plan: 2% platform fee per transaction.
  • Pro plan: 1% platform fee per transaction.

Payments are processed through Stripe. By accepting payments on the Platform, you agree to Stripe's Terms of Service. EventsNearMe is not responsible for disputes between Organizations and Vendors regarding payments or refunds.

Pro plan subscriptions are billed monthly. You may cancel at any time; your Pro benefits remain active through the end of the current billing period.

5. SMS Communications

Vendors may opt in to receive SMS (text message) notifications regarding booth approvals and payment reminders. SMS notifications are sent only when an Organization has enabled SMS for their event and the vendor has explicitly opted in at sign-up or in their account settings.

SMS opt-in is entirely optional and is not required to use the Platform. You can opt out at any time by replying STOP to any text message you receive from us, or by updating your notification preferences in your account settings. Message and data rates may apply. Message frequency varies.

6. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose.
  • Post false, misleading, or fraudulent content.
  • Impersonate any person or entity.
  • Attempt to gain unauthorized access to any part of the Platform.
  • Use automated tools to scrape or extract data from the Platform without prior written consent.
  • Interfere with or disrupt the integrity or performance of the Platform.

7. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, and software — are the exclusive property of EventsNearMe and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. EventsNearMe is not responsible for the actions, content, or data of third parties, including Organizations and Vendors using the Platform.

9. Limitation of Liability

To the fullest extent permitted by law, EventsNearMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Platform, even if we have been advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the Platform or sending an email. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.
